Mediation During Minnesota Divorce cases

In almost all Minnesota Divorce and Family Law cases, Mediation (or some other form of Alternative Dispute
Resolution such as SENE or FENE) is used as a means to help the parties resolve some or all contested issues.

The benefits of mediation are well documented in Minnesota, and particularly in the Twin Cities and surrounding areas, where ADR programs were developed as part of the Initial Case Management (ICMC) process for Family Law cases to help parties resolve contested issues at the beginning stages of a case, instead of focusing on the latter stages of a case.  Mediation helps to minimize the financial aspects of Divorce, and it yields better results than utilizing litigation to address issues that are very personal and unique to each case.

In Minnesota - Most Cases Do Settle

Mediation can be useful even if you have already attended one or more court hearings and have reached an impasse on contested issues. Very few cases go to trial (approximately 95% of cases settle before a trial).

Attorney and Mediator Randall A. Smith successfully mediates Divorce and Family Law cases involving disputes related to child support, parenting time, division of assets and debts, spousal maintenance (alimony) and post-decree issues (including Appeals).

Mr. Smith also has extensive experience in child custody cases (including cases with unmarried parents), child custody evaluations, issues related to co-parenting, addiction issues, mental health issues and Early Neutral Evaluations.

Associate Attorney Amber Bretl earned her J.D. from Hamline University School of Law and her B.A. in Political Science and Spanish from the University of Wisconsin-Eau Claire.  She is a member of the Minnesota Bar Association and is a Qualified Family Law Mediator under Minnesota Rule 114.
