MediationIn almost all Divorce & Family Law cases, mediation (or some other form of Alternative Dispute Resolution such as SENE or FENE) is used as a means to help the parties resolve some or all contested issues in the case.
The benefits of mediation are well documented in Minnesota, and particularly in the Twin Cities and surrounding areas, where ADR programs were developed as part of the Initial Case Management (ICMC) process for Family Law cases to help parties resolve contested issues at the beginning stages of a case, instead of focusing on the latter stages of a case.
Mediation can be useful even if you have already attended one or more court hearings and have reached an impasse on contested issues. Very few cases go to trial (approximately 95% of cases settle before a trial).
