Financial Expertise in Divorce Cases

In Divorce cases, financial expertise it vital, including the ability to precisely value Assets (such as Retirement Accounts, Brokerage Accounts, Real Estate, Businesses, Partnerships, S-Corporations, Pensions, Intellectual Property and Personal Property), to accurately trace Marital and Non-Marital Assets (when required) and to prepare a Balance Sheet identifying Assets and Debts as of the valuation date. In Minnesota, Spousal Maintenance (Alimony) is based upon need, and the equalization of cash flow (or available income) is not addressed by Minnesota Statue 518.552. The trend over the past five (5) years – especially in the Twin Cities – has been more temporary (also called rehabilitative) spousal maintenance awards, and fewer permanent spousal maintenance awards. Equalizing cash flow is not how we address spousal maintenance, but can be used as a baseline when negotiating financial aspects of the case. Spousal maintenance is need based, and equalizing cash flow may provide the recipient with cash in excess of their reasonable monthly budget.

Children and Divorce

In contested cases involving Child Custody or Parenting Time, a Social Early Neutral Evaluation (SENE) or Custody and Parenting Time Evaluation may be conducted to determine what is in the best interests of the minor children; the assistance of a Psychologist or Social Worker is common in High Conflict cases. Children should not be exposed to conflict during a Divorce or Family Law case.
